For home owners who are upside down on a mortgage and can't make their mortgage payment (because of job loss, divorce, or an adjustable rate increase), up until now the only option was, well, letting the bank foreclose.

A foreclosure should be the option of last resort. A foreclosure sits on your credit report for at least 10 years. A better option is the “short refinance" or a "short sale.”

A short sale prevents a foreclosure. Banks will listen to experienced negotiators who can show them a short sale will net them more money than a foreclosure. For you, the home owner, the advantages of a short sale will include not owing more on your home than it is worth, and not owing the bank any money after the short sale is concluded.

A short sale or a short refinance is the option of choice when it makes no economic sense to retain an asset like a home which has become so devalued that the mortgage is more than the market value of the property. A short sale is a sound business decision.

Red tape and a load of paperwork is very common in short sales, requiring potentially multiple levels of approvals and conditions. Junior liens - such as second mortgages, and HOA's may need to approve the short sale. Even if you are behind on your mortgage or have defaulted property taxes, we can help. When we convince your lender to write off the mortgage and accept the short sale, the forgiven debt is considered as income for the borrower and is liable to taxation. The Mortgage Forgiveness Debt Relief Act, however, obsolves such tax liability.

A short payoff to your lender is reported as a "settlement of the debt," whereas a foreclosure is reported as "non-payment of a debt."
